Student Code of Conduct

The Student Code of Conduct is a document of record under the College’s Policy Manual (Policy 5.30) and is published in full in the Student Handbook. This page summarizes the Code. Where this page and the Code differ, the Code governs.

Jurisdiction

The Code applies to enrolled students, including College Credit Plus students, and to student organizations. It applies to conduct on College property, including the Aviation and Heavy Equipment Annex and leased instructional sites; at College-sponsored activities wherever held; at practicum, clinical, and apprenticeship sites while the student is assigned there; and to off-campus conduct that substantially interferes with the operations of the College or the safety of its community. Academic integrity matters are addressed under the academic policies of the Catalog and are referred to the Dean of Students only where the Catalog so provides.

Process

  1. Notice. A student alleged to have violated the Code receives written notice stating the section alleged, a summary of the reported conduct, and the date of a scheduled meeting. Notice is sent to the student’s College e-mail address and is effective when sent.
  2. Meeting. The student meets with the Dean of Students or a designee, reviews the information the College has, and responds. The student may be accompanied by an advisor of their choice; the advisor may consult with the student but does not speak for the student. A student who does not attend does not delay the process, and a decision may be made on the information available.
  3. Decision. A written decision, stating any finding and any sanction, is issued within ten business days of the meeting. The standard of proof is the preponderance of the evidence.
  4. Appeal. A student may appeal to the Provost within ten business days of the decision, on one or more of three grounds: a material departure from procedure, new information not reasonably available at the time of the meeting, or a sanction disproportionate to the finding. The Provost’s determination is final.

The Dean of Students may impose interim measures, including restriction from a facility or activity, pending resolution where there is a reasonable concern for safety. Interim measures are not a finding.

Sanctions

One or more of the following may be imposed:

Suspension and dismissal are imposed only by the Dean of Students and are noted on the transcript for the period they are in effect. Matters governed by the Title IX Grievance Procedure (Policy 5.05) proceed under that policy rather than under this process.

Section 9.4 — presence in College facilities

Section 9.4 prohibits presence in College buildings, instructional structures, and grounds outside authorized hours. The prohibition includes overnight presence in any College building or on College grounds, without exception for weather, scheduling, or program obligation, and includes vehicles parked in College lots. A student who has nowhere to go on a given night should contact the Dean of Students at ext. 2140 during business hours or Campus Safety at ext. 2911 at any staffed hour, and will not be disciplined for asking.

Records

Conduct records are educational records under FERPA and are maintained by the Office of the Dean of Students, separately from the academic record. Records of matters resolved without a finding, or resolved by warning or probation, are retained for seven years after the student’s last enrollment. Records of suspension or dismissal are retained permanently. Conduct records are disclosed outside the College only as FERPA permits or requires.
